Terms of Service
1. Purpose
These general terms govern the use of the Privatly platform, a service that allows content creators to monetize their premium content with their subscribers.
2. Registration
Registration is open to adults. The creator agrees to provide accurate information during registration and to verify their email address.
3. Creator subscription
Access to the platform for creators requires a monthly subscription. The creator keeps 100% of the revenue generated by their subscribers. Privatly takes no commission on transactions. Payment processor fees (Payrexx AG) are deducted from each transaction in accordance with their current pricing terms. Fee details are available in the creator's dashboard.
4. Content
The creator is solely responsible for the content they publish. They guarantee they hold the necessary rights to all published content. Any illegal content is strictly prohibited.
5. Data protection
Privatly is committed to protecting personal data in accordance with the Swiss Federal Data Protection Act (FADP) and GDPR. Data is never sold to third parties.
6. Cancellation
The creator can cancel their subscription at any time. Access to the platform remains active until the end of the paid period.
7. Applicable law
These terms are governed by Swiss law. Any dispute shall be submitted to the competent courts of the canton of the operator's domicile.
8. Limitation of liability
Privatly shall not be held liable for indirect damages, loss of revenue, data loss or service interruptions resulting from the use of the platform. Privatly's total liability is limited to the amount of fees paid by the user during the last 12 months. Privatly does not guarantee uninterrupted availability of the service and shall not be held liable in case of force majeure.
9. Content and acceptable use
Creators agree not to publish any content that is illegal, defamatory, infringes on third-party intellectual property rights, contains images of minors, or incites hatred or violence. Privatly reserves the right to remove any content in violation and to suspend or terminate the creator's account without notice in case of serious violation.

Privatly is operated from Switzerland. Contact: contact@privatly.app. Payments are processed by Payrexx AG (PCI-DSS certified), Switzerland. Hosting: Vercel Inc. (USA) and Cloudflare Inc. (USA). All prices displayed on the platform are inclusive of all applicable taxes (TTC).
11. Dispute resolution
In the event of a dispute, you may submit a complaint to the European Online Dispute Resolution (ODR) platform at https://ec.europa.eu/consumers/odr. Before initiating legal proceedings, you agree to attempt resolution through good-faith negotiation by contacting us at contact@privatly.app.
